Gun Offenses

DC holds a variety of Gun Offenses, most dealing with unlawful possession of a firearm. They are: 


  • Felon in Possession of a Firearm/Unlawful Possession of a Firearm: This is a fairly straightforward charge in which someone convicted of a felony possesses a firearm, or if someone is a drug addict, has been convicted of a violent misdemeanor, or is fugitive from justice. These charges carry a mandatory 1-10 years imprisonment and/or a fine up to $15,000.
  • Carrying a Pistol Without a License (CPWL): This charge is levelled if someone possesses a pistol without the proper registration and licensing. This crime is a felony, with penalties maxing out at 5 years and/or $5,000. 
  • Possession of a Firearm during a Crime of Violence (PFCV): This is the presence of a gun during another violent crime, such as armed robbery, First Degree Sex Abuse, and Assault with a Dangerous Weapon (ADW). The sentencing range for this charge is 5-15 years, with the first five being ineligible for parole/probation. 


The following Gun Offenses are all misdemeanors. Therefore, their penalties max out at 1 year imprisonment and/or a $1,000 fine. 


  • Possession of Unregistered Firearm 
  • Unlawful Possession of Ammunition 
  • Unlawful Discharge of a Firearm 
  • Alteration of Identification Numbers 


In addition to these hefty penalties, a Gun Offense conviction has important implications for your Second Amendment rights. If convicted of a Gun Offense, you are required to register as a Gun Offender for your entire sentence, plus two years thereafter. You are also barred from purchasing, owning, or possessing a firearm in DC.
